Magicboat AI is a product developed and operated by Shanghai Jizhi Wujie Technology Co., Ltd. and its affiliates (collectively, "we," for details see the "Magicboat AI User Agreement"). The product includes websites, clients, mobile applications (APPs), and mini-programs (collectively, "Magicboat AI" or "this Product"), and will provide you with artificial intelligence ("AI") content generation services and other related services (collectively, "Services").

To facilitate your ("you") registration and use of this Product's services, we may collect and use your relevant personal information ("Personal Information"). We are fully aware of the importance of Personal Information to you and will do our utmost to protect your personal information and privacy.

You can quickly and easily understand the scenarios, purposes, and specific data types of our personal information collection by reviewing the "Personal Information Collection List" .

Through the "Magicboat AI Privacy Policy" ("this Privacy Policy" or "this Policy"), we will inform you of our rules for processing personal information and will collect and use your relevant data and information in accordance with this Policy. I. How We Collect and Use Your Personal Information

We will collect and use your personal information for the following purposes and in the following ways:

1.1 Account Registration and Login

1.1.1 We provide the services of this Product to you through a MiniMax platform account ("Account"). To use this Product, you need to provide true, accurate, complete, and valid registration information and materials ("Registration Information") to create an account. You can create an account using a mobile phone number, and we will use your mobile phone number to send you a verification code. A mobile phone number is necessary information to comply with national laws and regulations regarding real-name network registration. You should use your own mobile phone number for registration. If you do not provide a mobile phone number for registration and login, or if you do not create an account, we may not be able to provide you with all the features and services of this Product.

1.1.2 Based on our cooperation with telecommunication operators, we offer you a "one-click login" feature. To use this feature, you need to read and agree to the relevant agreements of the telecommunication operator. With your authorization and consent, we will use the feature provided by the telecommunication operator to use the mobile phone number on your device as your registration and login account, providing you with a quick registration and login service without the need for a password or dynamic verification code. If you do not wish to use the "one-click login" feature, you can register and log in through other methods.

1.1.3 You can use a third-party account to log in and use this Product. The third-party accounts supported for registration and login are subject to what is actually displayed on this Product. With your authorization and consent, we will obtain your registration information from the third-party platform (such as avatar, nickname, username, and other information you authorize) to create a product account linked to that third-party account, allowing you to directly register, log in, and use this Product. If you refuse the collection and use of the aforementioned information, you will not be able to use a third-party account to register and log in to this Product, but this will not affect your ability to register and log in through other methods.

1.1.4 After completing registration and login, you can set and perfect your account information (avatar, nickname, linking third-party accounts, etc.). You acknowledge and agree that your avatar and nickname may be publicly displayed within this Product.

1.2 Content Generation

1.2.1 Based on AI technology, we provide you with AI model video or image content generation services. To provide you with these services, we will collect the text, images, configuration parameters, and other instructions you actively input ("Generation Instructions" or "Input Content"). We will analyze the above information to generate content that meets your instructions and requirements ("Generated Content" or "Output Content").

When you actively take pictures, record videos, or upload files, to enable the necessary functions, we will request your authorization for camera and storage permissions (photos, media, and other files) based on the type and method of your input. If you refuse to grant authorization, you will not be able to take pictures, record videos, or upload files, but this will not affect your use of other Magicboat AI features.

Specifically, during your use of the content generation feature:

(1) We strongly advise and request that you do not input personal information that can identify you or others during your use of our services, as this type of personal information is not necessary for us to collect.

(2) If your input content contains the personal information of others, you must obtain their legal authorization before providing such information to avoid improper use or disclosure of their information.

(3) When you use the content generation service to process and create portrait-like materials, we may analyze the feature points and vector points of faces, portraits, or facial recognition feature information (collectively, "*face information") in your input content to assist you in using the service, but we will not use such information to identify specific natural persons. In this process:

(4) Users must not use new technologies and applications such as deep learning, virtual reality, and generative AI to create, upload, copy, transmit, or disseminate false news information or other content prohibited by laws and regulations, nor misrepresent synthetic content as natural content. When you publish or disseminate non-real information created using new technologies and applications such as deep learning, virtual reality, and generative AI, you must clearly label it. Otherwise, we have the right to take measures against the relevant content and account, including but not limited to adding labels, restricting, or banning them.

1.2.2 You can access and manage your generated content through your personal homepage, including publishing it publicly. If you choose to publicly publish generated content, other users can access and view the generated content and its corresponding generation instructions through this Product, and use those generation instructions to create content. If you do not agree to this Product and other users using your generated content and generation instructions, you can choose not to publish the generated content publicly.

1.2.3 When you use the video generation feature or play videos, to adapt to your device's status, we may use device sensors such as the accelerometer, gyroscope, and gravity sensor to identify your device's screen orientation (portrait or landscape).

1.3 Payment Services

1.3.1 You can subscribe to the paid services of this Product. During the subscription process, you may need to make a payment. In the payment process, we may collect your *third-party payment account information (such as Alipay account, depending on the payment method you actually use) and *order payment information.

1.3.2 You can apply for an invoice from us for the paid services you have subscribed to. Depending on the type of invoice you request, we will collect and use one or more of the following pieces of information: email address, invoice title (personal name or company name), company tax ID, company address and phone number, bank name and account number, proof of special invoice status, and proof of entrustment relationship. If you refuse to provide the above information or provide incorrect information, we will not be able to issue an invoice for you. You can correct, supplement, or resubmit the correct and necessary information.

1.4 User Feedback and Service

When you consult with us, file an appeal, or make a complaint, to facilitate contact with you or help resolve the issue, we may need you to provide a mobile phone number or email address. If you refuse to provide the above information, we may not be able to provide you with timely feedback on the processing results.

1.5 Ensuring Service Security

To ensure the stability and security of the system when you use our software, prevent your personal information from being illegally obtained, more accurately prevent fraud, and protect account security, we need to collect your device information (including device name, device brand, device model and specifications, device manufacturer, MAC address, device identifiers (IMEI/MEID/AndroidID/OpenUDID/IMSI/IDFA/OAID and other device identifiers formed from comprehensive device parameters), device MD5 value (MD5 value encrypted based on the device's MAC address), sensor list, device startup time, device initialization time, operating system version, country, language, time zone set in the operating system, resolution, system update time and its identifier, service provider network ID, network location information (approximate geographical location information obtained through IP address, carrier information, base station information, nearby Wi-Fi, and connected Wi-Fi, collected only to the country/province/city level), and login information (mobile phone number, SMS verification code) to assess your account risk, and may record some links ("URLs") that we consider risky; we will also collect your device information to analyze our system problems, count traffic, and investigate potential risks, and to troubleshoot when you choose to send us exception information. If you do not provide the above information, we will not be able to protect your service and account security while you are using our services.

1.6 Improving Services

1.6.1 We will collect information about your behavior while using this Product, including your clicks, browsing, following, liking, feedback, sharing, uploading, downloading, publishing, searching, and rating actions, to provide you with services and to improve the quality of our services.

1.6.2 After processing with secure encryption technology, de-identification, and ensuring that specific individuals cannot be re-identified, we may analyze and use input content, output content, and behavioral information for model training to continuously adjust and optimize model effects and product experience.

1.6.3 We may use de-identified information alone or in combination, and conduct data analysis to count the number and source of users, analyze the usage of this Product, discover and resolve product failures, conduct internal audits, data analysis and research, and use third-party SDK statistical services to continuously improve this Product and provide you with better services.

1.7 Message Notifications

You acknowledge and agree that during our operations, we may send you message notifications related to this Product or the services you use via your terminal device. You can choose whether to receive notifications by adjusting the "Notifications" permission settings on your terminal device. We may also send you notifications, as well as commercial information about services, features, or activities that may interest you, via the mobile phone number you provided, through SMS or phone calls. If you do not wish to receive this information, you can unsubscribe using the method provided in the SMS, or contact us to unsubscribe through the contact methods listed in this policy.

1.8 Device Permission Invocation

In the course of providing services to you, we will invoke your main device permissions. You can choose to turn off some or all permissions in your device's settings. The way permissions are displayed and turned off may vary on different devices; please refer to the instructions or guidelines of your device and system developer for details. The main device permissions we invoke are as follows:

For situations where we may need to invoke your device permissions, we will separately prompt you to enable the permission the first time we invoke it. Please note that enabling these permissions means you authorize us to collect and use the corresponding personal information through the respective permissions to achieve the corresponding functions. Disabling a permission means you revoke this authorization, and we will no longer collect your personal information through that device permission and will be unable to provide you with the corresponding function.

1.9 Exceptions to Obtaining Authorized Consent

According to relevant laws and regulations, in the following circumstances, we may collect and use necessary personal information without obtaining your authorized consent:

Special reminder: If information, after processing, cannot be used alone or in combination with other information to identify a specific natural person, it does not fall under the legal definition of personal information. According to the law, its use, processing, sharing, transfer, and public disclosure do not require separate notification to you or your consent.

1.10 Use of Cookies and Similar Technologies

1.10.1 Cookies and similar technologies like device information identifiers are commonly used technologies on the internet. If you accept Cookies, we may use Cookies and similar technologies to collect, identify, and store information when you visit and use this Product.

1.10.2 You can accept, refuse, or manage Cookies through your browser settings. If you refuse Cookies, you may not be able to enjoy the best service experience, and the availability of certain functions may be affected.

II. How We Entrust Processing, Share, Transfer, and Publicly Disclose Your Personal Information

2.1 Entrusted Processing and Sharing

2.1.1 We will not share your personal information with any company, organization, or individual, except in one or more of the following situations:

(2) At your own request;

A. Content moderation service providers: To ensure that the content published by users on the internet information platform is safe, we may share the information content you input and publish in this Product with a third-party content moderation service provider.

B. Advertising and statistical analysis partners: To help with advertising or decision-making suggestions, improve the effective reach of information content, and further understand user needs, we may share de-identified device information or statistical information with partners who entrust us and/or whom we entrust to carry out information promotion and advertising, or with statistical analysis partners. This information is difficult or impossible to associate with your real identity.

C. Cooperating third-party SDK service providers: When you use this Product, we may integrate software development kits (SDKs) provided by third parties to implement related functions (such as third-party account login, payment, and notification functions). Third-party SDK service providers may directly collect your relevant information (in the form of embedded code, plugins, etc.). Please note that these third-party entities have privacy policies different from ours. Please review their privacy policies before using this Product and/or third-party SDK services. You acknowledge and agree that we will make commercially reasonable efforts to require these third parties to take protective measures for your personal information, but we cannot guarantee that they will take protective measures as we require, nor do we assume any responsibility for the actions and consequences of these third parties.

(5) When you choose to participate in marketing activities organized by us and our affiliated companies or other partners, you may need to provide information such as your name and contact information. Refusing to provide this information may prevent you from participating in the relevant activities, but will not affect your use of other functions of this Product. Only with your consent will we share this information with affiliated companies or partners to ensure you receive a consistent service experience in the activity, or for partners to promptly deliver rewards to you.

(6) Necessary sharing with our affiliated companies: We may share your personal information with our affiliated companies. We will only share necessary personal information, and this sharing is bound by the purposes stated in this policy. If an affiliated company wants to change the purpose of processing personal information, it will seek your authorization and consent again.

(7) Other circumstances stipulated by relevant laws and regulations.

2.2 Transfer

III. How We Store and Protect Your Personal Information

3.1 How We Store Your Personal Information

3.1.1 In accordance with legal and regulatory provisions, we will store the personal information we collect and generate during our domestic operations within the territory of the People's Republic of China.

3.1.2 We will retain your personal information only for the period necessary for the purposes of providing the services. After you delete your account or actively delete your personal information, when the retention period expires, when your information is no longer needed to achieve the purposes and uses specified in this policy, and when it is no longer necessary to retain it according to relevant laws and regulations, we will delete, destroy, or anonymize the personal information.

(1) In the event of a personal information security incident, we will, in accordance with legal and regulatory requirements, promptly inform you of the basic situation and possible impact of the security incident, the disposal measures we have taken or will take, suggestions for you to independently prevent and reduce risks, and remedial measures for you. Upon receiving your deletion request, we will carry out subsequent processing and provide you with feedback on the results in accordance with your request and relevant laws and regulations. We will also notify entities that have obtained your personal information from us to delete it in a timely manner, unless otherwise stipulated by laws and regulations, or if these entities have obtained your independent authorization. After you or we assist you in deleting the relevant information, due to applicable laws and security technologies, we may not be able to immediately delete the corresponding information from the backup system. We will securely store your personal information and isolate it from any further processing until the backup can be cleared or anonymized.

4.3 Changing or Withdrawing Your Authorization

You have the right to change the scope of your authorized consent or withdraw your authorization. For device permission authorization, you can change or turn it off on your terminal device. For other personal information authorization, you can contact us through the methods listed in this policy to change the scope of your authorization or withdraw your authorization. Please fully understand and be aware that some business functions require necessary personal information to be completed. Changing the scope of authorization or withdrawing authorization may affect your continued use of related functions or services, but will not affect the personal information processing activities that have been carried out based on your consent before the withdrawal.

4.4 Protection of Deceased Users' Personal Information

After a user (limited to natural persons) passes away, their close relatives, for their own legitimate and proper interests, can exercise rights such as accessing, correcting, and deleting the deceased user's relevant personal information through the contact methods specified in this policy, unless the deceased user made other arrangements before their death. To fully protect the personal information rights of the deceased, the close relatives applying to exercise these rights need to complete identity verification procedures and promise and guarantee that their exercise of these rights does not violate the deceased's prior arrangements and that the purpose of exercising the rights is legitimate and proper.

4.5 Deleting Your Account

You can apply to delete your account according to the instructions in this Product. Before you delete your account, we may verify your personal identity, security status, and device information. You acknowledge and understand that deleting an account is an irreversible action. After deleting your account, we will stop providing you with Magicboat AI services and will delete all data and information from your account during its existence in Magicboat AI or anonymize it. Deleting your account only in Magicboat AI will not affect your continued use of other MiniMax services through your MiniMax platform account.

4.6 Responding to Your Requests

To ensure security, we may require you to provide written materials or prove your identity in other ways. We will respond to your request within fifteen working days after receiving your feedback and verifying your identity.

For reasonable requests, we generally do not charge a fee, but for repeated requests that exceed reasonable limits, we will charge a certain cost fee as appropriate.

For requests that are groundlessly repetitive, require excessive technical means, pose risks to the legitimate rights and interests of others, or are very impractical, we may refuse them.

However, you acknowledge and agree that in the following situations, as required by law and regulations, we may not be able to respond to your request:

(1) Related to national security and defense security;

(2) Related to public safety, public health, and significant public interests;

(3) Related to criminal investigation, prosecution, and trial;

(4) There is sufficient evidence to show that you have subjective malice or are abusing your rights;

(5) Responding to your request will cause serious damage to the legitimate rights and interests of you or other individuals or organizations.

V. Protection of Minors' Information

5.1 We place great importance on the protection of minors' personal information. Magicboat AI's services are primarily intended for adults. If you are a minor under the age of 18, you should, under the supervision and guidance of your guardian and with their consent, carefully read and agree to this policy and the "Rules for the Protection of Minors' Personal Information" before using this Product. If you have not obtained your guardian's consent, the guardian can contact us through the methods listed in this policy to handle the relevant account, and we have the right to restrict the functions and use of the relevant account, including but not limited to browsing, publishing information, and interactive communication functions.

5.2 For cases where we collect personal information of minors with the consent of their legal guardians, we will only use such information when permitted by law, with the explicit consent of the guardian, or when necessary to protect the minor.

5.3 If your guardian does not agree to you providing your personal information to us in accordance with this privacy policy, please notify us immediately so that we can process your information.
